Terms of Service

Supplier Identity and Contact

These Terms are provided by Dialogue, Räbacher 7, 8143 Stallikon, Switzerland. For legal, billing, and contract questions, contact hi@nicolasmenard.design.

Scope of Terms

These Terms are B2B-first and apply to business customers using Dialogue services. If mandatory consumer protection law applies to your purchase, those statutory rights prevail over conflicting terms.

Service Description

Dialogue provides scoped diary-study operations and reporting workflows that support product decisions through structured user feedback and evidence synthesis.

Plans, Pricing, and Checkout Disclosures

Plan scope, included limits, and recurring price are shown before checkout. For paid subscriptions, taxes and billing disclosures are presented during the checkout flow. Stripe acts as payment processor.

Subscription Renewal and Billing

Managed subscriptions renew automatically on the billing cycle unless canceled. You authorize recurring charges for your selected plan until cancellation takes effect.

Cancellation

You can cancel at any time by emailing hi@nicolasmenard.design from your billing contact email. Cancellation stops future renewals; fees already charged for the active period are not refunded unless required by applicable law.

EU Consumer Withdrawal and Digital Service Execution

If you contract as an EU consumer, withdrawal and related rights are described in EU Consumer Rights. Business customers may cancel per these Terms and renewal settings. Where legally required, checkout and onboarding will request the acknowledgements needed for digital service start during the withdrawal period.

Customer Responsibilities and Acceptable Use

You are responsible for the legality and accuracy of data you submit, including participant details and consent where required. You must not use the service for unlawful activity, security abuse, or rights violations.

Intellectual Property and License

Dialogue retains all rights in the platform, workflows, and documentation. You receive a limited, non-exclusive, non-transferable right to use the service during your active subscription or agreed service period.

Service Changes and Availability

We may update, improve, or modify service features to maintain security, compliance, or product quality. We do not guarantee uninterrupted availability and may perform maintenance windows as needed.

Limitation of Liability

To the maximum extent allowed by law, Dialogue is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data. Nothing in these Terms limits liability where such limitation is prohibited by mandatory law.

Governing Law and Jurisdiction

These Terms are governed by Swiss law, excluding conflict-of-law rules. For business customers, courts in Zurich, Switzerland, have exclusive jurisdiction unless otherwise agreed in writing. Mandatory consumer protection rights and forum rules remain unaffected where applicable.
